What We Do

Banking

The Banking Team members of the Care Team have a broad range of experience in drafting and advising on loan funding documents and issues that are critical to operators of care homes. 

Members of the Banking Team have acted for both lenders and borrowers in the care sector (including Extracare) on loan documentation, security documentation, inter-creditor arrangements, guarantee arrangements and other conditions precedent.  The Banking Team works closely with the Construction, Property and Corporate Teams, as a number of loan transactions include elements which cross over into these areas of law, such as a negotiation of collateral warranties and other construction documentation. 

The Banking Team has experience in dealing with both development finance documentation used when acquiring, developing and re-developing care homes, together with acquisition finance facilities to fund the acquisition of care home businesses.  Examples of previous transactions include:

• Acting for Lloyds TSB Bank Plc on loan facilities to an Extracare provider to fund the development of various properties in the Midlands
• Acting for NHP and Southern Cross on their loan facilities to fund development of care homes and acquisition of other care home businesses
