The Property Team members of the Care Group are frequently asked to advise on the termination and alienation provisions in leases both in respect of office leases taken on expressly to service regional Supporting People Contracts and in relation to accommodation provided to care service users. Care service providers are increasingly concerned to ensure flexibility in this changing climate where early termination or renegotiation of Supporting People Contracts is no longer uncommon and where these contracts are no longer financially viable.
Our experienced property solicitors have also drafted and negotiated suites of documents to ensure a joined up approach to property and care obligations; e.g. where property is leased by a care provider under funding arrangements with the local authority set out in a collaboration agreement with termination provisions reflected in break clauses in the lease.
