We have extensive experience of defending judicial review applications. This is an increasing area in education and we have recently seen cases relating to the establishment of Academies and the recent case brought by the Independent Schools Council which successfully challenged the Charity Commission’s ‘public benefit’ tests to determine whether their charitable status is justified. As schools become more independent, an increase in judicial reviews of individual school’s decisions is inevitable.
