The rise of CHP and the provision of energy services

The use of CHP is ever increasing, particularly as part of residential developments. The increase in energy prices and the need to reduce the carbon output of such developments has led to the rise in on-site energy provision. The major energy providers often propose a suite of documents relating to their CHP provision, which will need to be reviewed and agreed to ensure the requirements for the development, being served by the CHP, will be met and relevant objectives achieved.

We have experience of both standard form and bespoke drafting of energy contracts. Specifically, Devonshires was involved in developing guidance on standardising energy service contracts in the public sector.

We are familiar with the profile and allocation of risk in both the public and private sector and have a full appreciation of the commercial and “green” drivers which may be relevant.

Our clients include Registered Providers and Local Authorities in relation to energy contracts, both in terms of bespoke contracts, and more standardised documentation particularly emanating from the large energy providers in the UK. We have advised in the context of mixed use developments, residential developments and PFI contracts and understand the inter-relationships involved in such projects.
