The Department deals with all aspects of Housing Management Litigation including progressing possession proceedings, proceedings brought under the Anti-Social Behaviour Act 2003 including Injunction applications, Anti-Social Behaviour Orders and has achieved an outstandingly high success rate in respect of all types of cases including defending disrepair actions.
Possession proceedings form the bulk of work undertaken and we cover all types of possession work from fixed fee for rent arrears possession claims and squatter proceedings, through breach of tenancy claims, unlawful sub-letting, anti-social behaviour and other more complex claims (e.g. possession claims against former short-life occupants and occupants claiming adverse possession).
The team have been involved in a number of high profile cases which have been dealt with by the Appeal Courts including most recently the cases of Kay v Lambeth (2006) House of Lords (the leading case on Housing and Human Rights), and Circle Thirty Three v Ellis (2005). This is now the leading case on applications by tenants for reinstatement following eviction.
