A wrongful birth claim is brought where sterilisation techniques have failed and an unexpected pregnancy results, or when a doctor fails to diagnose a genetic problem or disability and the parents are denied an opportunity to consider termination.
In a failed sterilisation case you will be compensated for the pain and distress of an unwanted pregnancy and labour. This award is often around £5,000, although it could be more if there were complications. You may also be able to claim for financial losses (such as loss of earnings) during the unwanted pregnancy. However, you will not be compensated for the cost of bringing up any child born unless that child is born disabled. It is also possible in certain circumstances to receive an award in the region of £15,000 as a result of the lost right to limit the size of your family.
