Procurement

The team provides advice to a wide range of “Contracting Authorities” (including local authorities, housing associations, ALMOs, the Tenant Services Authority and the Homes and Communities Agency) on their obligations under the EU Public Procurement Regulations.

This has included advice on when the Regulations apply, the procedures to be followed to procure works, services and supplies, evaluation criteria and the consequences of not complying with the Regulations.

We have provided procurement advice to numerous local authorities on PFI / PPP and other major projects. We have also advised in relation to other more specific areas such as the treatment of complex development agreements and framework agreements under the Regulations.

We have advised on the establishment of a considerable number of common procurement vehicles and have advised such organisations in relation to their obligations under the Regulations in procuring works, services and supplies on behalf of their Contracting Authority members.

As with any practice operating in this sphere, we are fully up to speed with the regulatory environment and the increasing influence that case law is now finally having upon the manner in which procurements are conducted. For procurers, the service that we can offer in this respect includes a real “cradle to grave” approach. Namely, we draft PIN and OJEU notices, various invitation documents, assist with evaluation frameworks, through to issuing contract award notices. We also deal with a whole range of disputes in relation to the procurement process including obtaining and defending applications for injunctions and claims for damages.
